Terms of Use
The terms that apply to this website, and the general terms behind every quotation and order.
Website use
By using this website you agree to these terms. If you do not agree, please do not use the site.
You may browse the site and use its forms for their intended purpose: to learn about our objects and to make an enquiry, request a quotation or request a sample. You may not use the site in a way that damages it, interferes with other users, or breaks any law.
This website is operated by OMVATO LTD (company code 156838056).
Product information
We take care to describe our objects accurately. Images, dimensions, materials and colours are given as a guide. Screens show colour differently, and natural materials vary from piece to piece. Small differences between what you see on the site and what you receive are not a defect.
Where a specification, price or availability is not shown, it has not yet been confirmed. Nothing on the site is an offer to sell. The details that bind us are those in a written quotation and order confirmation.
Quotations
A quotation is prepared from the information you give us. It sets out the objects, quantities, customisation, pricing, delivery and the period for which it is valid. A quotation may be revised if the information it was based on changes, or if it has expired.
Orders
An order is placed when you accept a quotation in writing. It becomes binding when we send an order confirmation. The order confirmation, together with the quotation and these terms, forms the agreement between us. If there is a conflict, the order confirmation takes priority.
Orders for organisations are also subject to our Corporate Order Terms.
Pricing
Prices are those stated in the quotation. Unless the quotation says otherwise, prices exclude taxes, duties, delivery and customisation, which are shown separately. If our costs change materially before an order is confirmed, we may issue a revised quotation.
Payment
Payment terms, including any deposit and the balance due, are stated in the quotation and order confirmation. Production does not begin until any required deposit has been received. We may suspend work or delivery if a payment is overdue.
Customization
Customised objects are made to your instructions and carry your branding or engraving. You are responsible for the accuracy of the artwork, text and specifications you supply. We will follow the approved proof. Because customised objects are made for you, they cannot be resold and are generally not returnable unless they are defective.
Approvals
Before customised production begins, we will send a proof for your approval. Approval must be given in writing. Please check spelling, placement, size and colour carefully. Once approved, the proof is the standard we produce to, and later changes may affect price and timing.
Intellectual property
The Omvato name, logo, product designs, photography and the content of this website belong to us or our licensors. You may not copy or reuse them without our written permission.
Logos and artwork you supply remain yours. By supplying them, you confirm you have the right to use them and you give us permission to reproduce them on the objects and proofs for your order.
Delivery
Delivery dates are estimates given in good faith. They depend on approval of proofs, receipt of payment and the availability of materials. We will tell you promptly if a date changes. Risk in the objects passes to you on delivery to the address you have given. Please inspect deliveries on arrival and report any damage or shortfall without delay.
Returns
Returns are accepted within the period, and on the conditions, stated in the applicable order confirmation and in our Returns Policy. Customised objects are generally not returnable unless they are defective.
Warranty
Our objects are covered against defects in materials and workmanship for the period stated in our Warranty Policy and the applicable order confirmation. The warranty does not cover ordinary wear, misuse or damage caused after delivery. Your statutory rights are not affected.
Limitations
Nothing in these terms limits liability that cannot be limited by law. Subject to that, we are not liable for indirect or consequential loss, and our total liability in connection with an order is limited to the amount paid for that order.
The website is provided as it is. We do not promise that it will be available without interruption or free of errors.
Governing law
These terms are governed by the law of the Republic of Rwanda, and the courts of Rwanda have exclusive authority over any dispute, unless the applicable order confirmation states otherwise.
Changes
We may update these terms from time to time. The current version is always published on this page, with its effective date at the top. Changes do not affect orders already confirmed.
